Kahn Wins Case Against EA

Guess its all how you look at it. The music thing is a good example.

I went to see Dropkick Murphy's, and they were like, buy our album if you want, but you can just download it off napster.

This other band who is local to Dallas, Sub Oslo, have the same mentality, except they posted a link directly to audiogalaxy :( (so sad that its not the same anymore) where you can download all of there music for free.

On the other hand, our local rock station, 97.1, has an anti file swapping commercial that goes something like this....you just released your first record, but its already been downloaded a million times....

Now I'll tell you, I play in a band, and if my record was downloaded a million times on the net, I would be flipping out (with joy that is), a million poeple want to hear my music, then great. If your THAT popular your not going to have any problem selling out shows, or getting record contracts. You'd be making plenty of money.

So for me it is about greed, if your that concerned with making money with your music, then your heart isn't in it.

Now, not saying that Kahn's heart isn't in it, I think he is being greedy. I mean come on, how much is his contract worth, aren't there a little more important things in this world, all of the millions of poeple starving who could never dream of how much money he has, he should feel god damn lucky and thanking whatever god every second of his life for what he has been given, could so easily be taken away...... anyway

LOL. Why not call him Olive Cu|\|t... He's absolutely retarded not wanting international recognition. It's not like EA used his image to advertise the game in any way. He's just in there to add to the realism. What's more, I believe EA has the FifPro license? He probably needs the money for his wife's settlement or something

The question here is not, if mister Kahn is greedy!

There are two relevant questions here. The morality of the case, just to be loved by all interested soccer gamers, is not important. I could call someone naive, arrogant or greedy as weell, but it doesn't mean I'm having more or less rights than another person, get it?

Question 1:
The use of someones name or image, without the permission of the person himself, or the institute responsible for this matter; COULD it in THEORY damage the reputation and/or future of this person. Answer: YES, indeed.
Example:
Suppose this wasn't a soccer game, but a porn game. That COULD damage the person of O. Kahn. So the question if the usage of the name and image of O. Kahn really DID damage the person, isn't relevant. In law, the only question that counts, is the one of possibilities.

Question 2:
Did EA make any mistakes? Answer: yes, they did.

Indeed, it's the easiest way, to make a big fuss about it, and collect the money for it afterwards, but EA Sports isn't clean in this one.
Example:
Obviously, permission was granted for the 2002 games of EA Sports, that does not mean the 2004 series, does it? Well, in that case EA made it difficult on themselves and only O. Kahn and the De Boer - brothers were keen (and greedy) enough to make their (judicial) use of it.

Furthermore, if (again) IN THEORY this could damage one person, it could damage all of them just as well, which means that any other player within Bayern, or German leagues or worldwide (depending on which person or firm is holiding the rights and belongings.) could go out to court and claim exactly their same right, depending on how much damage, they think, it'll have on their person.
The POSSIBLE damage of one or more persons goes, beyond the pleasure and profit
(let's not forget EA tries to put as many real names and faces in the game, for their own sales and profit: in it for the money)
that EA will experience, because YOU (gamers) are buying the game.

Now, you won't suffer any damage from having the game, or not (unless you bought a false or defect version; you didn't get what you payed for.) because there is hardly any difference.
But the person, that has been made use off, needs compensation for it and if O. Kahn didn't get the legal compensation he claims, than he stands in his full right. Again, morally speaking I agree with most of you folks, but it is his right to do so.

If I was put in game (lol) without any compensation, I would get quite pissed off too. But I allready explained that earlier in the discussion, with that example from the music-bizz (where thankfully, somebody backs me up)

But its hard for poeple to detach themselves from the material world, concentraing on "image" and superficial things like that.

We just look at it differently, me, if I was good enough to be put in a game, I probably would have made plenty of money by then, and I would just be happy to be noticed.

D we see your point. However...

A1: They do have permission thats why they use the names of the real players (as opposed to generic ones). In theory I should have a Ferrari, in actuallity I have a VW GTI... Two different things my friend. In actuallity, he game is not a porn game, it is a soccer/football game. He's a greedy f*** plain and simple.

Why didnt he sue his club for giving the rights to use his name in the game? Right... you dont sh** where you eat... Simple

I am not arguing with the judicial system. My "beef" is that someone that should be a role model not a penny pinching @#$%

Lets face it.. if my face was in a game "or the likleyness of me" and millions of copies were sold world wide... I WOULD PEE ON MYSELF in excitement !!! To sue a gaming company for doing that is pure greed (my opinion)!!!

Really, to even end up in a game like this, you must've worked pretty damn hard. So if you end up after a lifetime of work in game without your own permission, you'd be pretty pissed off, too
I worked my entire ass off and what do I get in return: nothing. Okay, a virtual face & name in a soccergame. That's like mistreatment of your time, input and sacrifices (remember, no matter what you think of him -or any other player for that matter- these guys were determined to become the most succesfull footballers of their country ever since they were young! The same applies anyone who is famous and/or succesfull) And if some computergame-producer isn't willing to respect that (in terms of permission -I looked it up, there wasn't!- or compensation) then the fabricator of this game, fortunatly DO have a problem.

I might be standing on my own (obviously), but I agree with Kahn. I'm not looking at what game-producer is involved, or what game he might be in and he should be happy about it; I'm not looking at the money mr. Kahn's allready got; I'm looking at what's right and wrong legally. I'm looking at supposable situations and in that case Kahn is absolutely right.

Well D.. all I can say is that I respect your opinion even if I can not agree with the Kahn thing.

What pisses me off is that he is starting a crusade asking other players to do the same. So assuming he wins this case and others follow .. where dose this end?

The real point here is the fact of Kahn being well know by all the soccer communities around the world. What I'm trying to say is that Oliver is a big star and he wants to be (financialy) recognized by EA Sports, 'cause he has a pessoal image and marketing to preserve. He has a good reason to do what he did, even if it doesn't look fair for us.

What I can't undertand is why he did that and Ronaldo or Zidane, for example, don't do the same.

Because Ronaldo and Zidane are world stars in their hearts as well as with their playing abilities. Beckham has a management company that oversees every use of his image but you don't see them chasing down EA or Konami. Kahn is a first class prick, nothing less. He may have image rights like any other professional but let's face it, if you're pulling in about $30,000 a week who really gives a crap about some Shifty*inal sum for a computer game - oh, other than greedy bastards!
