FIFA to ban all Italian clubs if Juve appeals?

Juve appeal puts Italian clubs at risk :alex:

FIFA could ban World Cup champion Italy and all Italian clubs from international competition if Juventus challenges in state court the sanctions it received in the country's match-fixing scandal.

FIFA spokesman Andreas Herren said Wednesday that forcing a decision before a state court would interfere with the autonomy of the soccer world and undermine the sport's arbitration system.

In a letter sent by president Sepp Blatter to the Italian federation on Tuesday, FIFA said it was prepared to ban all Italian clubs -- as well as the national team -- from international soccer if Juventus goes ahead with its legal action.

"The president referred the Italian federation to Article 61, which states that the decisions of sports courts may not be brought before an administrative court. It also stipulates that national federations must have such an article within their statute books," FIFA said.

Juventus announced after a board meeting Monday that it planned to appeal to an administrative court in Rome, although it has not formally taken such a step.

"If Juventus go before an administrative court, then FIFA pass the matter to its emergency committee," Herren said. "The committee wouldn't even have to meet in person. It (the suspension of all Italian teams) could happen very quickly."

A suspension, if it were imposed, would be indefinite and could stop the national team from taking part in the qualifying competition for the 2008 European Championship.

Herren said that in an "ideal situation, the Italian federation will solve this problem within its own sports courts."

Juventus indicated no change in its plans.

"We're convinced we're not doing anything wrong, because we're simply applying a law of the Italian state," Juventus lawyer Riccardo Montanaro was quoted by the ANSA news agency.

A ruling on July 14 stripped Juventus of its last two Serie A titles and relegated the Turin powerhouse to the second division. A sports appeals court on July 25 reduced Juve's point penalty from 30 to 17.

The club argues that the punishment it received was unduly harsh, and that it lost millions as a result.

Three other Italian clubs involved in the match-fixing scandal received point penalties, but were not relegated.

Juve still want to appeal, after they got Serie B, the home game ban lifted and their point deduction reduced?

I'd like to quote Bayern's general manager: "We don't support dirty pigs like them!"

If FIFA had a pair I'd be seriously worried. Juve keep appealing but to be honest I don't think Serie A is happening. Nice move by FIFA though, now we know they're taking the most important aspects of the game seriously(Y)

The Italian justice system is f*cked up. Juve might aswell make use of it... just like all the other clubs involved do.

Something similar happened last year when Internacional wanted to appeal against Brazilian FA's decision to replay 11 matches, which ultimately gave the title to Corinthians by a single point (or maybe two, can't remember). Internacional didn't appeal and ended up winning the f'ing Libertadores...

Juve, in their egoistic as ever style, officialy appealed and by doing so screwed the FIGC and maybe the rest of Italy in the same movement :

Well Fifa has a problem with club teams appealing to civil courts, this is not allowed in their reglementation and could lead to a dangerous precedent, if this goes through and Juve gets reinstated by the civil courts, the FIGC and Fifa have a big problem.

This could get as big as a new "Bosman arrest" case, opening the path for every club to take legal civil action against football association decisions they don't agree with :)

It is however allowed in the Italian reglementation to appeal to TAR, so Juventus is only following a path they have legally the right to follow if they wish to do so, and they're doing it. In fact so could Milan, Fiorentina, Lazio, Reggina and Arrezo if they should wish too.

This will of course bring a new postponement of the Serie A and B start and would throw the calendars into chaos with the UEFA competitions and the League Cup tournaments that have already started.

I only care for my club :D And I will not be sad if I'm out of Europe as long as Inter and Juventus are out of it too :hit: My hate for them is about as big as my love for Milan if not bigger.
