Everton legal action over Mourinhos comments onAJ

Everton had previously asked for a retraction of Mourinho's "possibly defamatory" allegations - but Chelsea refused to comment on Monday.

Johnson himself said: "I merely jumped out of the way of Chelsea's goalkeeper as he came out at my feet. I do not consider myself to be a diver."

Johnson, who joined Everton in the summer from Crystal Palace, added: "I was not trying to get a penalty. I have to say that I feel greatly disappointed that my integrity as a footballer has been unfairly questioned.

"I believe the incident highlighted by Mr Mourinho was badly misinterpreted by him. I hope that the Chelsea manager will retract his statement."

On Sunday, after the game, Mourinho had said: "He's dangerous for opponents because you cannot trust him, and I was not happy with that.





"But I think he was a bit embarrassed and he behaved very well after that."

The Chelsea boss stopped short of calling Johnson a cheat but stated: "In my country we call them 'intelligent' players. In other countries you can use different words and are critical.

"I've been in this country for three years now and I am influenced by your culture. It is a country I admire, I am proud to be part of it.

"For me when a player chases a penalty, he is no longer an intelligent player."

Everton boss David Moyes reacted furiously to Mourinho's accusations - clashing with him on the touchline after the Portuguese made a diving motion with his hands.

Moyes said after the game: "He (Mourinho) has got a big 15 stone striker up front who is quite partial to it (diving) himself.

"I saw the incident on television and I don't think it was a penalty but it certainly wasn't a dive either.


We would urge the footballing authorities to look closely at Mr Mourinho's comment and then, perhaps, seek a formal explanation

Joint statement from Everton and Johnson's agent

"A few weeks ago the Chelsea keeper got caught by a Reading player, who was criticised for that.

"Our player is slightly bumped, straddles the goalkeeper and jumps over him. He's missed the keeper and he gets criticised for that, so you can't win."

Everton issued a joint statement with Johnson's agent Anthony McFarlane on Monday.

It read: "To query a player of Andrew's integrity is wholly unacceptable and possibly defamatory. We ask Mr Mourinho to immediately retract his allegations.

"We would urge the footballing authorities to look closely at Mr Mourinho's comment and then, perhaps, seek a formal explanation.

"Both Everton FC and Andrew Johnson have always believed in the virtues of fair play."

It has been claimed that Everton are considering taking legal action against Mourinho because they believe the reputations of the player and the club were damaged by his comments.

According to a report by the Press Association, Everton are aware that Mourinho gave several, slightly different, interviews after the game.

The one they will base their complaint on is the interview Mourinho gave to Sky Sports in which it is claimed he says: "I know he dives."

Everton reportedly have a full transcript of that interview.

A bit unfair on Johnson he did not appeal when he went down, and he was pushed by Boulla so i don't see why Mourinho is criticizing him. i don't know why Johnson has this reputation when there are certain individuals who dive on a regular basis don’t want to mention any names. for once im against Mourinho i really feel sorry for Johnson becuse he is trying to clean up his act.

mourinho cant have things both ways. if johnson didnt dive over hilario he would have smashed into him. after the match mourinho would complain that hilario didn't get enough protection. i hope mourinho gets sued, he wants his cake and to eat it too.

Well I guess you would wouldnt you....

Everton are 100% right to go through with this. If you take nothing but the incident into consideration then, there is hard evidence that it was not a dive, neither was Johnson claiming that it was a penalty.

Not only that but, Everton complained about Mourinho's comments at the weekend... they also gave Chelsea a good 2 days to issue a statement/apology on the matter. But of course the London club have kept quiet hoping it would all blow over, keeping their egos intact.

Mourinho is a man who isn't scared to speak up, and he almost always speaks his mind... and let's face it, often enough he is right. However in this occasion he is completely in the wrong. Add to that the complete hypocrisy of the statement for a manager of a side where Robben and Drogba and more have a notorious past when it comes to being diving sissies.

Hope the FA lay into them, and him especially.

This is pathetic, and all because it's Chelsea.

Chris Coleman called Johnson a diver this season but did the media wank off over that?....Did Everton threaten to sue Coleman over that?....The answer to both issues is NO they didn't.

I personally do not believe that on this occasion AJ did dive. I think Jose has read AJ's intentions wrongly. I believe that he fell the way he did to avoid hurting Hilario. I would imagine that the Cech/Cudicini situation flashed through his head and he probably thought," I have to miss the keeper or I will be hung drawn and quatered by everyone if I hurt him too".

Saying all of that, I am amazed that with AJ's previous record of diving that Everton are making such a meal over all of this. AJ is a diver, that we all know so where is the argument?

Has anyone been threatened with legal action by Chelsea for calling Drogba or Robben divers? No they have not. The reason why is obvious. Its because they have both in the past been serial divers so they have no credible defence to offer.

AJ is in the same position. All Chelsea have to do is produce video evidence of the many times that AJ has dived for Palace and Everton and Evertons libel case is sunk. He has a reputation as a diver and that will not leave him for a while yet.

The same can be said of Drogba and Robben. Both are working hard to eradicate cheating from their game, but as we see from this thread neither will ever be recognised for their efforts to clean up. Why is that? Because they are CHELSEA players.

Its hypocrisy to praise AJ for trying to clean up his image and in the same breath fail to recognise that other players are doing the same thing too.

Everton have made themselves and AJ look like the pratts they are. Its funny how everyone gets upset when Chelsea are involved but ignore the same situation when Chelsea are not involved. Transparently pathetic.

Let them do what they like. We dont give a fu<k. Are people gonna love Jose more if he apologises? Will they suddenly all love chelsea? Of course not so why give a toss what anyone thinks or says. Fu<k 'em all, every last one of them.

Kind of hard to defend Drogba when you witness his antics against Lehmann last weekend.

Of course, having the blue tinted glasses on will compel you to hide behind this Chelsea v's everyone bull**** when i can tell you, if any of the various football phone-in's are anything to go by there is many a decent Chelsea fan out there embarrassed by Mourinho's constant outbursts. In fact just this evening, this very topic was discussed at length on talksport and not one Chelsea fan phoned in to defend Mourinho this time.

AND, the reason you don't get Chelsea fans phoning Talk Sport TA, is because that station has become the radio version of the Sun. Mainly hosted by ex footballers who used to play a good game but have nothing of value to say. This station has jumped on the "We hate Chelsea" bandwagon from day one, so why the fu<k do you think any decent Chelsea fan would waste their time with a moronic staiton like that?

If you like to listen to thick scousers with a chip on their shoulders and middle class wankers who know nothing about football, then thats up to you mate......The station aint called "Talk s.h.i.te" for nothing.

Talk Sport aint fans of United either. Johnson does go down but Boluarouz pushed him. Its a statement. Freedom of speech get on with the game move on with your life.

Moyes and Everton are losers. The same guys tried to take action against Rooney for his book. Pathetic. Moyes needs to move on instead of concentrating on what people are saying. Mourinho didnt ask him to leave Beattie and McFadden on the bench did he? Mourinho is entitled to his own opinion.

I've never listened to 505 mate.

Phone ins in general are for those people who want to air their views to a wider audience instead of just getting all worked up and frustated on their own. Football phone ins are led in a certain direction by the hosts and if they decide to have another "anti Chelsea" day which it seems is every day, then all you will get is the same idiots phoning in to scream and whine about, Chelsea this and Chelsea that.

Personally, I have no interest at all in the opinions of other clubs fans as far as Chelsea is concerned so, if a particular radio show is having another "anti Chelsea" day, then I just do not listen to it. Many Chelsea fans do the same thing. We just do not give a toss what anyone else thinks. Is that so hard to understand mate?

I'd be very surprised if ever I heard a Manc, a scouser or a gooner come on to Talk S.h.i.te and defend Chelsea wouldn't you. So why would we want to waste our time listening to crap like that in the first place. Its just an excuse for all the whingers to agree with each other, including that scouse has- been presenter, that was slagging Chelsea earlier this evening.

I think it's fair. The football pitch is like a workplace where each individual barring the fans earn their money. What Mourinho did was not only unprofessional, but is an insult to his fellow colleagues. Imagine if someone at your workplace called you a rapist without any evidence which mostly is untrue and you have your rep spoiled, I'm sure you'd do something about it. The reason Everton are lodging the complain is not about doing something to Mourinho, it's about making him pay for the bad rep that he gave Johnson and Everton.
